2. General Conditions of Sale
All sales made by Fireboks South Africa (“the Supplier”) to any customer (“the Customer”) are subject to these Terms, whether arising from:

These Terms supersede any other conditions, except where the Consumer Protection Act (CPA) applies.
No variation or cancellation of these Terms shall be valid unless confirmed in writing by a senior manager of Fireboks South Africa.
3. Orders

Customers are responsible for ensuring the correct product selection before completing a purchase.

Fireboks South Africa may impose reasonable cancellation charges.

Delays caused by circumstances beyond our control do not constitute grounds for cancellation.

Special-order items require a 60% non-refundable deposit if cancelled. Manufacturing of special-order goods is at our discretion.
4. Pricing & Payment

All prices are based on current costs and are subject to change due to increases in materials, transport, taxes, exchange rates, or other factors.

Quotations are valid for 14 days, unless stated otherwise.

Payment is required prior to delivery, unless a written credit agreement exists.

Interest on overdue accounts will be charged at 5% above the prime lending rate.

Discounts apply only if payment is made strictly on time.
5. Delivery & Collection

Delivery dates are estimates and not guaranteed.

Customers must ensure someone is available to receive goods.

Large items require assistance for offloading.

Goods must be inspected upon delivery before signing.

Any visible damage must be noted on the delivery documentation and reported immediately.

Risk passes to the customer once goods are delivered or collected.

International orders are supplied ex-works.
6. Ownership & Risk
Ownership of goods remains with Fireboks South Africa until full payment has been received. Risk passes to the customer upon delivery or collection.
7. Returns & Refunds
Returns are governed by the Consumer Protection Act and Fireboks South Africa’s Refund Policy.
Products may be returned:

If they do not match their description or sample

If unsuitable for a declared purpose (within 10 business days)

If purchased online, within 7 days of delivery
Returned goods must:

Be unused and uninstalled

Be in original condition and packaging

Include proof of delivery
Custom-made or installed products are non-refundable, unless defective.
No returns will be accepted after 30 days, unless authorised by a company director.
8. Cancellations
Fireboks South Africa may cancel any order if:

The customer fails to make payment

The customer becomes insolvent
Special orders cannot be cancelled once manufacturing has commenced.
9. Warranties & Guarantees

Fireboks South Africa’s liability is limited to repair or replacement of defective goods.

No liability is accepted for indirect or consequential losses.

Installation costs are not covered under warranty.

Products must be installed and used according to specifications.

Guarantees are void if products are misused, altered, or incorrectly installed.

Some products carry guarantees of up to 15 years (as specified per product).
10. Installation & Use Disclaimer

Fireplaces and braais must be installed correctly and safely.

Open fireplaces and installations in thatched structures carry inherent risks.

Fireboks South Africa is not liable for damages resulting from misuse, incorrect installation, or poor draught conditions.

Customers use all products at their own risk.
11. Third-Party Links
We are not responsible for the content, policies, or practices of third-party websites linked from our Service.
12. Suspension of Services
If a customer breaches these Terms or fails to make payment, Fireboks South Africa reserves the right to:

Suspend delivery

Cancel credit facilities

Retain payments already made

Recover outstanding amounts
13. Legal Costs
The customer agrees to pay all legal costs incurred by Fireboks South Africa in enforcing these Terms, including attorney-and-client costs.
14. Arbitration
Any dispute regarding pricing or outstanding balances may be referred to Fireboks South Africa’s auditors, whose decision will be final and binding.
15. Jurisdiction
These Terms are governed by the laws of the Republic of South Africa. Fireboks South Africa may institute legal action in any competent South African court.
16. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Material changes will be communicated where reasonably possible.
